Audio Leaks Probe: IHC issues a restraining order

Former Chief Justice of Pakistan Justice Retired Saqib Nisar's son challenged the formation of a special committee to investigate the alleged audio leaks by the Speaker National Assembly in the Islamabad High Court.

In the petition, the former chief justice's son contended that the alleged audio leaks were the result of illegal surveillance and invasion of privacy of the petitioner. The court declared that the recording of private conversations of private persons is a violation of fundamental rights.

According to the petitioner, the committee set up by the Speaker National Assembly to investigate the alleged audio leaks is illegal. Without a meeting of the committee, a personal summons notice by the secretary of the committee is also not valid. According to the law, an audio leak can be included in a trial or investigation only if it is known who recorded the audio and what is the purpose of recording.

The petitioner took the stand that the committee formed by the speaker should be declared illegal, the proceedings of the committee should be suspended till the decision on the petition and orders should be issued not to take disciplinary action against the petitioner.
